入境确诊,雇主要负责?

外劳入境新加坡14天内确诊covid-19,医药费要由雇主负责?
如果入境时确诊,却遇上无良老板炒鱿鱼,怎么办?
我问了MOM之后,他们并没有正面回答我的问题,但他们的确表达了 “雇主需要为员工负责” 的概念。
不止如此,本篇解答还适用于所有非工伤医疗情况,希望你花几分钟读完,然后分享出去。

 

前不久,新闻报道有位23岁的马来西亚女生,持着Work Permit入境新加坡却在履行居家通知(Stay Home Notice)期间确证,引起一波热议。
其实每天都有不少外籍员工入境新加坡,也屡屡听闻客工在入境不久被验出确诊。
我们都知道MOM网站上指出,雇主需要帮员工负担入境确诊的医药费,但也有不少人为老板喊冤。

 

为了给大家最正确的消息,我再次大胆的email向MOM求解。
过了好几天,总算收到他们的官方回复了。
长话短说的话,MOM并没有正面回答我的问题,但他们的确表达了“雇主需要为员工负责”的概念。
而且本篇适用于所有非工伤医疗情况。

 

先附上我向MOM询问的信息:
原文:
I understand the foreign work permit and S Pass holder whom return to Singapore but been confirmed infected by covid-19 within 14 days if her/his return, the employer had to bear the medical cost and all necessary payment/charges related.
But can the employer request the worker to pay back the charges after he/she recovered and return to workplace?
Can the employer terminate the mentioned worker’s employment during his/her admission time at hospital or quarantine facilities?
If the employer failed to comply etc refused to pay the medical bill, will MOM assist the foreign worker in the event?
Or if the employer requests the foreign worker to pay back the fee(s), it’s non-compliance with Employment Act?
As some cases shared at social media (Facebook), their employer requests the foreign worker to provide deposit or letter undertaking before employer apply PCA or MOM Entry approval for them return to workplace. Is the action allowable?

我了解Work Permit和S Pass持有人入境新加坡的14天内,若被确认感染了covid-19,雇主必须承担医疗费用以及所有相关的费用。
但是,雇主可以要求员工在康复并复职后,偿还雇主所为他/她缴付的费用吗?
雇主可以在他/她入院或隔离设施期间,终止这位确诊员工的聘雇合约(解雇他/她)吗?
如果雇主未能遵守甚至拒绝支付他/她的医疗费用,MOM会在这种情况下协助外籍员工吗?
还是如果雇主要求外籍员工偿还费用,那是违反《雇佣法》的行为吗?
正如在社交媒体(Facebook)上分享的一些情况一样,一些网友的雇主要求他们提供押金或保证信承诺自费确诊费用,才同意帮他们申请PCA或MOM Entry批准,让他们重返新加坡工作。请问这项行为是被允许吗?

 

时隔多日后,MOM正式回复我的email。其原文如下:
The employer must cancel the Work Permit (WP) within 1 week after the pass holder’s last day of notice or 1 day after the WP expires, whichever comes first.
The employer would need to terminate his employment according to the terms of his employment contract and give him notice in writing. The employer must also resolve all outstanding employment issues (including payment of salaries) before cancelling the permit. To smoothen the repatriation process, the employer should also reach a mutual agreement on the repatriation date and destination.
Please note that the employer is responsible for your worker(s)’ upkeep and maintenance during their stay in Singapore, and the cost of your worker’s repatriation once he/she is ready to leave Singapore.

Generally, as an employer, you must buy and maintain medical insurance coverage of at least $15,000 per year for each Work Permit holder which covers the inpatient care and day surgery, including hospital bills for conditions that may not be work related.
You can have a co-pay arrangement with the Work Permit holder only if all of the following are met:
•The medical treatment is not for work-related inpatient expenses.
•The co-pay amount is reasonable and does not exceed 10% of the worker’s monthly salary.
•The duration co-payment does not exceed 6 months.
•The co-payment option is explicitly in the employment contract or collective agreement and has the worker’s full consent.

雇主必须在员工离职后的1星期内,或通行证到期的1天内(视何者为先),取消此人的Work Permit。
雇主需要根据其雇用合同的条款终止其雇用,并书面通知他。雇主还必须解决所有未解决的雇佣问题(包括支付工资),然后再取消工作证。为了简化遣返程序,雇主还应就遣返日期和目的地,与该离职员工达成共同协议。
请注意,雇主需要负责该外籍员工,在新加坡逗留期间的生活费和该员工离开新加坡的遣返费用。

通常,作为雇主,你必须为每位Work Permit持有者,购买每年最少新币S$15,000的医疗保险,承保住院护理和日间手术,包括与工作无关的医疗费用。
只有满足以下所有条件,你才可以与Work Permit持有人共同承当医疗费用:
• 没有与工作有关的医药费用
• “共同承当费用”是合理数额,并且不超过该员工月薪的10%
• “共同承当费用”的期限,不超过六个月
• “共同承当费用”明确列在雇佣合同或协议中,并得到该员工的同意

值得注意的是,以上MOM官员回复仅限于Work Permit。
所以如果事主换成S Pass、E Pass还是PR、新加坡公民,可能答案会有不同。
